Microsoft beats Motorola in German SMS patent suit, litigation world cup continues

Munich's regional court has ruled that Motorola is infringing one of Microsoft's patents relating to displaying multiple SMS messages. It's one of the sub-cases that's separate to the larger FRAND matters that are raging along in the background, but still has enormous ramifications. Redmond's deputy general counsel, David Howard said that he hoped Motorola would (join over 70 percent of all Android OEMs) license Microsoft's patent portfolio. If Google's latest plaything doesn't start writing cheques, then it's likely to have its handsets banned from Germany, at least in the short term.

(AP) ? President Barack Obama delivered his harshest rebuttal yet to rival Mitt Romney on Thursday, dismissing his challenger's claims as "a cowpie of distortions" while seeking to rekindle the all-but-faded Iowa magic that launched him in 2008. Escalating his criticism of Romney's background as a venture capitalist, Obama said it wasn't adequate preparation for the presidency.

"There may be value for that kind of experience, but it's not in the White House," Obama said.

The speech, to a cheering Iowa crowd of about 2,500 at the Iowa State Fairgrounds, represented a new intensity for Obama's campaign as Romney begins to hit his stride carrying the Republican standard. It came as Iowa, soured by the direction of the nation and its economy, has drifted away from Obama since his 2008 caucus victory over Hillary Rodham Clinton made him the Democratic front-runner.

While Obama carried the state in the general election by a comfortable margin that year, polls this year have shown voters narrowly preferring Romney, who plans to wage his own major effort in Iowa.

Trying to cast Romney as out of touch with working-class voters, Obama declared that hard work hasn't led to higher incomes. "Higher profits haven't led to better jobs," he said. "And you can't solve that problem if you can't even see that it's a problem."

Obama pointedly chose the same turf where Romney, the presumptive Republican nominee, once declared that corporations are people. Obama said Romney would roll back regulations and return to policies that he said helped create the recession and would increase government deficits.

Reacting to Romney's charge last week that Obama had created "a prairie fire of debt," the president countered that Romney's tax plan is "like trying to put out a prairie fire with some gasoline."

In a statement issued after the speech, Romney spokesman Ryan Williams said: "A president who broke his promise to cut the deficit in half by the end of his first term has no standing when it comes to fiscal responsibility."

Earlier, in blue-collar Newton, Iowa, once the prosperous headquarters of Maytag appliances, Obama visited a wind-turbine plant to push his alternative energy agenda and delivered a message that could as well have applied to all of Iowa. "Yeah, we're facing tough times, but we're getting through them, we're getting though them together," he said.

While offering only six of the 270 electoral votes needed to win the presidency, how Iowa voters ultimately judge Obama is expected to be an important factor in the race.

"Last time it was a lot more exciting. It was a new thing," said Nancy Bobo, a Des Moines Obama volunteer and one of his earliest Iowa backers in 2008. "Today, we're all just very serious."

Romney, a former Massachusetts governor, has made the struggling economy the centerpiece of his campaign. But Obama can point to comparatively low 5.1 percent unemployment in Iowa, where stable financial services and strong agriculture sectors buoyed the economy while manufacturing has struggled to rebound.

Romney had made the comment about corporations as he argued against raising taxes as a way of shoring up Social Security and Medicare. Members of the audience interrupted, calling for increased taxes on corporations, and Romney responded: "Corporations are people, my friend. ... Everything corporations earn ultimately goes to people."

The comment has been used by opponents to characterize Romney, a former private equity firm executive, as more comfortable in the boardroom than the shop floor.

Obama's campaign has emphasized episodes in which Romney's former firm closed plants and laid off workers, and has aired a stinging TV ad on the subject in Iowa, Colorado, Ohio, Pennsylvania and Virginia.

In his fairgrounds' speech Thursday, Obama said private-equity firms can sometimes create jobs. "But when maximizing short-term gains for your investors rather than building companies that last is your goal," he added, "then sometimes it goes the other way. Workers get laid off. Benefits disappear. Pensions are cut. Factories go dark."

Obama himself has struggled to attract blue-collar voters, keys to winning struggling swing working-class regions such as southeast Ohio, western Pennsylvania and rural Iowa. Newton is the seat of Jasper County, Iowa, where unemployment was 7.1 percent in April, higher than Iowa's average but down sharply from last winter.

While Iowa is known for its first-in-the-nation caucuses, it also is a coveted general election state, despite its small electoral total. Democrat Al Gore carried the state by less than a percentage point in 2000, followed by Republican George W. Bush's 2-point victory in 2004.

Obama has already spent more than $2.6 million on advertising, a pace as aggressive as in any other battleground state. He's been a regular visitor, and was making his second trip in a month.

Yet the president's approval rating here has been stuck below 50 percent for over two years, softened in part by criticism from Republicans campaigning for Iowa's leadoff caucuses.

Polls show Iowans also have become increasingly bothered by federal spending, an issue Romney stoked in Des Moines last week in a visit where he promised to shrink the deficit.

Iowans, many of whom met Obama in the 2008 campaign, also are disappointed by what they hoped would be a transcendent presidency, said J. Ann Selzer, the longtime director of The Des Moines Register's Iowa Poll.

"You hear disaffection. You hear them say, 'This isn't what I paid for,'" Selzer said. "The guy they sent there to recast things wasn't able to do it."

Privately updating Senate Democrats on Thursday, Obama campaign manager Jim Messina said the president has several possible paths to collecting the 270 electoral votes he needs for victory in November. But he noted that Romney, the Republican Party and allied super PACs are likely to have a great deal of money to spend. Obama vastly outspent Republican John McCain in winning the White House four years ago, an advantage that Democrats appear unlikely to command in 2012.

Romney senses the opening. He too has cultivated an Iowa network. Indeed, he campaigned aggressively for the 2008 caucuses during his narrowly losing bid for the state's delegates. Romney and the Republican National Committee have hired state directors and are hiring staff to run a dozen or more offices planned for Iowa.

And his campaign has begun running television ads in Iowa.

What Makes Small Business Content Marketing Better Than Big ...

Small businesses often think that they can?t afford to do content marketing or, if they can, they can?t afford to compete with their big business counterparts.

This couldn?t be further from the truth. While the money that you have to work with may differ, the fundamentals of content marketing are the same whether you?re a Fortune 500 company or a startup small business. Content marketing, in many ways, requires more time than money.

In fact, small business content marketing has some advantages over big business. Let me explain what I mean on some slightly different terms.

I?m a big fan of indie music and small singer/songwriter acts that sort of fly under the mainstream radar. I could give you a list of some of my favorites, but I wouldn?t be surprised if you said, ?I?ve never heard of any of those people before.? Most people haven?t. But the fans they amass are typically fiercely loyal to them and so share their music with everyone who will listen. For example, all of my friends and family have heard about Butch Walker because I haven?t shut up about him in fifteen years.

Something else I love about these kinds of bands? They get large followings on social media sites, but not so large that they?re untouchable. Most of them are tweeting and posting to Facebook themselves, as opposed to having an assistant do it for them. They?re interacting with fans and a lot of them are so grateful for every single one because they don?t take fans for granted the way a large mainstream act might.

I hope you see where I?m going here and how it relates to content marketing for small and big business. There are certain benefits to being a small business when it comes to content marketing, and though money may not be one of them, it doesn?t mean you can?t do a heck of a job with what you?ve got.

Ability to know your audience on social media?

It?s arguably easier to build closer relationships with your customers, clients, and prospects when your numbers are smaller. Because you can get to know them a bit better, you can learn a little bit more about what they want and need from your content.

Let?s say a larger corporation gets between 100 and 200 new followers on Twitter every day. Are those corporations going to send each of those followers a quick tweet to thank them? Will they reach out at all short of maybe replying to a complaint? Some will, but many will not. They?ve got too much on their hands to read all of their incoming tweets.

On the other hand, if you?re getting 10-20 new followers every day, that?s a much more manageable number. You can interact with your following. Take a look at what they?re tweeting about or posting to Facebook and see what kind of conversation you can strike up. In short, you have the ability to be more genuinely social.

Whereas some big businesses will pay a lot of money to use monitoring tools to learn what their prospects had for breakfast that morning, you?re in a position to strike up a conversation with them about it. The more time you invest into building these relationships organically, the more you increase your chances of having the kind of fiercely loyal following that will tell everyone they know about you.

?and use it to tailor your content

You were probably wondering when I was going to bring this back to straight content marketing, but don?t worry. I wouldn?t leave you hanging like that.

When you leverage social media or regular in-person interactions (something else that?s tough to come by with big businesses) to get to really know your followers, you can use that information to tailor your content. Like I said before, maybe you can?t afford tools to monitor in incredible depth, but you have the power of conversation at your fingertips.

Let?s say you?re a local sporting goods store, and you see a few occasional customers on Twitter talking about a fishing trip they?re taking this weekend. You chime in, and pretty soon, through natural conversation, you discover that one of them has some questions about some of his fishing equipment.

Hello, tomorrow?s blog post.

So you write a timely blog post about the Fisherman?s Top 5 or something pertaining to the conversation, and you?ve answered their questions and met their needs. Keep in mind, those were questions and needs they didn?t even know they had until they were talking to you.

And when you share that content across your various social media platforms, you?re more likely to see it shared around because you?ve built such an engaged following.

Personalization

This sort of ties in with everything else I?ve said, but it?s really the key here. With big businesses, things can tend to feel impersonal. You can?t connect a name with a face because there are so many faces, and even when you can, it?s hard to really get to know that person. So the content can often feel, for lack of a better word, cold. There?s just not a lot of character to it.

On the other hand, there are countless small businesses whose leaders are jumping right in when it comes to content marketing. They?re writing their own blog posts and interacting with their clients and prospective followers on social media sites. They?re answering questions through video blogs. In short, their fingerprints are all over the content marketing efforts.

In conclusion, these may not seem like really profound points. That?s because they?re so simple and so obvious, but yet so overlooked given that so many small businesses think they can?t compete with big businesses when it comes to content marketing. Don?t get me wrong: there are big businesses that do a really fantastic job of content marketing in a personal way. But this is really the space where small businesses have an advantage. They have the ability to jump right in, be personal, get to know their following, and generate the content those followers want and need.

Romney's record at Bain Capital is fair game, Obama says (+video)

?What I would say is, Mr. Romney is responsible for the proposals he?s putting forward for how he says he?s going to fix the economy,? Obama said. ?And if the main basis for him suggesting he can do a better job is his track record as the head of a private-equity firm, then both the upsides and the downsides are worth examining.?

Obama also offered up a tutorial on the difference between being president and running a private-equity firm. When you?re president, he said, your job is not just to maximize profits.

?Your job is to figure out how everybody in the country has a fair shot,? the president said. ?Your job is to think about those workers who get laid off, and how are we paying for their retraining. Your job is to think about how those communities can start creating new clusters so that they can attract new businesses.?

Obama continued, ?Your job as president is to think about, how do we set up an equitable tax system, so that everybody?s paying their fair share, that allows us to invest in science and technology and infrastructure, all of which will help us grow.?

Mayor Booker?s defense of private equity Sunday on NBC?s ?Meet the Press? rocketed into the political stratosphere, as he explained that he lives ?in a state where pension funds, unions, and other people invest in companies like Bain Capital.?

?If you look at the totality of Bain Capital's record, they've done a lot to support businesses, to grow businesses,? Booker said.

Other Democrats, including former Rep. Harold Ford of Tennessee and Steve Rattner, Obama?s former ?car czar,? have also come to the defense of the private-equity world as a source of capital to grow businesses and jobs.

The Obama campaign has focused attacks on the companies that ended up failing under Bain ? even as Bain itself profited.

On Monday, Obama also defended Booker as ?an outstanding mayor? who is ?doing great work in Newark? to turn the city around. But he took issue with Booker?s characterization that the campaign attacks are a ?distraction.? Booker had criticized both the Obama campaign?s attacks on Bain Capital and a proposal (not by the Romney campaign) to use Obama?s former pastor, the Rev. Jeremiah Wright, to attack the president.

Romney reacted to Obama?s press conference by accusing the president of refusing to take moral responsibility for his ?failed policies.?

?President Obama confirmed today that he will continue his attacks on the free enterprise system, which Mayor Booker and other leading Democrats have spoken out against,? the former governor of Massachusetts said in a statement. ?What this election is about is the 23 million Americans who are still struggling to find work and the millions who have lost their homes and have fallen into poverty. President Obama refuses to accept moral responsibility for his failed policies. My campaign is offering a positive agenda to help America get back to work.?
